TERMS AND CONDITIONS
Sundaysunset.images reserves the right to change any of the terms of this agreement at any time, and you agree to be bound by such changes.
Cancellation or Rescheduling: Your non-refundable sitting fee will be forfeited upon any cancellation, rescheduling or 30 minutes tardy - Please be punctual.
Preview: You can review all your photos and select your favorite images online within 7 days of your session. All your images will be available online for a period of 30 DAYS from the first publication date. Prices are subject to change without notification.
Payment: Once a selection is made and paid for online, no changes are possible and all sales are final. Please check your order carefully before you submit your payment. All sales are final.
Delivery: All purchases will be available for collection or delivery (if requested) within 2 to 3 weeks.
Orders: All orders shall remain the property of the Studio until full payment has been made. Orders cannot be separated for collection unless paid for in full.
Collection Fee: If the PURCHASER fails to pay and collect any order within fourteen (14) days of notification of completion, the order shall be in default and the Studio shall charge a default charge of 1.5% per month (18% annual rate) on the unpaid balance (minimum monthly charge of $5.00). Please acknowledge that no future orders will be processed until the Order is paid in full.
Ownership: The Studio owns the Copyright in all photographs. You give permission to the Studio to use any image of your sitting for industry competitions and as required subsequent usage and for reasonable general promotional advertising for the Studio. The usage for any other purpose is to be renegotiated between the parties and requires specific permission by you.
Reproduction: As the Studio owns the Copyright, You agree not to copy, cause to be copied or allow anyone else to copy, photocopy,
laser copy, burn or computer scan these images. To do so is in breach of these terms. You will use these photographs as agreed and understand they may not be copied or reproduced unless written approval is granted by the Studio.
Storage: The Digital Negatives remain the property of the Studio and will be kept on file a period of five years for re-orders. You may be able to negotiate with the Studio for release of the Negatives.
Professionalism: The Studio shall carry out your booking with due and professional diligence. Elements beyond the Studio’s control include faulty material, equipment failure, damaged digital files, loss of files/photos/digital negatives in transit between the Studio and professional laboratories employed by the Studio, loss or damage to digital negatives and proofs during processing and developing either by the Studio or professional laboratories employed by the Studio, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent the Studio completing in whole or in part this assignment. In this case the Studio shall not be liable for its complete performance of the assignment.
Limitation of Liability: Sundaysunset.images is not liable for failure to perform and/or damages of any type, actual and/or incidental, caused by incidents beyond the reasonable control of Sundaysunset.images. Sundaysunset.images is also not responsible for missed pictures. In the event that Sundaysunset.images is liable for a failure to perform the maximum liability of Sundaysunset.images shall not exceed the sitting fee.
